On Tuesday, 13 May 2014 at 17:00 Professor Larry A. Bakken, Hamline University, Faculty of Law, will give a public lecture on Recent Trends in Private and Commercial ADR in the USA with an introduction by Professor Dr. Frank Diedrich, RGSL.
Alternative Dispute Resolution is the overarching legal term denominating all attempts of the parties to settle a dispute confidentially out of state courts.
There are numerous forms of ADR with negotiation, mediation/conciliation and arbitration being the most prominent. The US have been the trendsetter since the 1970s, mainly due to the high litigation costs caused by court and lawyer’s fees, discovery proceedings and its challenging (unpredictable) jury system with sometimes outrageous punitive damages. Meanwhile Member States of the EU and states like Japan have been following suit.
Prof. Bakken is going to highlight the latest trends in the US that might again have a vital influence on the approaches taken in the European Union.
